The present essay intends to discuss the relations between the theoretical models that influence the judicial activity and the transformations of the Judiciary. In a context of redefinition of the role of justice and, specially, of consolidation of new expectations regarding judges in democracy, it is essential to analyze the basis on which the judicial decisions and the procedural dynamics are legitimated.
