Abstract

The research contrasts the limited outcomes of self-regulation models and soft law instruments with the new due diligence obligations imposed by the European legal framework. The CSDDD institutionalizes a continuous duty of conduct throughout the value chain, imposing compliance criteria regarding human rights and environmental protection on transnational corporations. This text examines how the standing granted to actors from third countries alters the procedural dynamics in European courts and impacts the traditional legal protection of extractive operations. The analysis indicates that the regulation promotes a reinterpretation of legal certainty, balancing the requirements for foreign investment protection with socio-environmental oversight duties.
