Design Algoritmico, Responsabilità da Prodotto e la Tutela dei Minori Online: K.G.M. v. Meta Platforms, Inc., et al. e Lezioni per l'ECA Digitale del Brasile

Questo articolo esamina l'emergente paradigma giuridico della responsabilità algoritmica attraverso un'analisi comparativa del contenzioso statunitense K.G.M. v. Meta Platforms, Inc., et al. e dello Statuto Digitale per i Minori e gli Adolescenti del Brasile (Brasile, 2025). Si sostiene che entrambi gli sviluppi segnalino un cambiamento strutturale nel trattamento giuridico delle piattaforme digitali, da intermediari neutrali protetti da ampi regimi di immunità a progettisti di ambienti comportamentali soggetti a doveri di diligenza, sicurezza e mitigazione del rischio. L'analisi si concentra su come gli attori in K.G.M. avanzino una teoria di responsabilità basata sulla condotta che mira all'architettura della piattaforma — come i sistemi di raccomandazione algoritmica, lo scorrimento infinito (infinite scroll) e le funzioni di massimizzazione del coinvolgimento — piuttosto che ai contenuti di terze parti, sfidando così la portata tradizionale dell'immunità della Sezione 230. L'articolo adotta un approccio dottrinale e interdisciplinare, combinando l'analisi giuridica della responsabilità dell'intermediario, della responsabilità da prodotto e dei vincoli costituzionali con una revisione della letteratura empirica su social media e salute mentale degli adolescenti. Viene esaminato il ruolo della conoscenza aziendale, dei documenti interni e della prevedibilità nello stabilire la responsabilità, affrontando anche i limiti delle analogie con i precedenti contenziosi di salute pubblica, in particolare i casi del tabacco. I risultati suggeriscono che, sebbene le prove scientifiche sui danni dei social media rimangano eterogenee, lo standard giuridico di prevedibilità non richiede consenso e la consapevolezza aziendale interna gioca un ruolo decisivo nel colmare le lacune probatorie. Nella sezione comparativa, l'articolo analizza l'ECA Digitale come un quadro normativo proattivo che rende operative preoccupazioni simili attraverso obblighi ex ante, inclusi requisiti di safety-by-design, valutazione del rischio e restrizioni sulle pratiche di sfruttamento. Si sostiene che il modello brasiliano rappresenti un consolidamento legislativo di teorie che sono ancora in fase di sperimentazione attraverso contenziosi negli Stati Uniti. L'articolo conclude che questi sviluppi paralleli riflettono una più ampia convergenza transnazionale verso il riconoscimento del design delle piattaforme come fonte di danno giuridicamente rilevante.
