Abstract

This article investigates the relationships between allegations of parental alienation and reports of domestic violence found in judicial proceedings in Brazil, focusing on the application of Law No. 12.318 (Brasil, 2010) (the Parental Alienation Law) as an instrument for perpetuating gender violence. As an empirical counterpoint, the study draws on judicial rulings, understood not merely as legal decisions but also as “state truths” responsible for shaping family dynamics more broadly and dictating specific rules on the roles to be followed by parents and, above all, by mothers, the main individuals accused of practicing parental alienation. Based on the analysis of judicial decisions published up to 2022, a structured questionnaire was developed to categorize the information both quantitatively and qualitatively; it also made it possible to understand how parental alienation is mobilized in cases of domestic violence, particularly those involving protective measures. The preliminary results show that the Parental Alienation Law has been used as a defense strategy by aggressors to mitigate domestic violence, delegitimizing complaints and revictimizing women. In light of this, the study seeks to contribute to the debate on the legal and political implications of the Parental Alienation Law in view of feminist struggles and the protection of victims of domestic violence.
