Predictive policing and the criminal law of risk: the european AI Act as a parameter for restraining algorithmic investigation in Brazil

Predictive policing and facial recognition are spreading across Brazilian public security without specific legal grounds or control mechanisms, while Regulation (EU) 2024/1689, the AI Act, classifies such practices as posing unacceptable or high risk. This article examines to what extent the European framework can serve as a parameter for restraining algorithmic investigation in Brazil. It adopts the deductive method, with comparative bibliographical, documentary and case-law research, articulating the theory of the criminal law of risk, the literature on data-driven policing and Brazilian law. It concludes that the AI Act offers transferable parameters, especially the prohibition of individual crime prediction, the requirement of a legal basis and impact assessment, but that the transplant requires a critical mediation by the reality of structural racism and by the constitutional regime of guarantees, lest it legitimize the very expansion it sought to restrain.
