Abstract

La disobbedienza civile e l’obiezione di coscienza sono pratiche sociali distinte, sebbene interrelate, che evidenziano l’opposizione degli individui a leggi, politiche, direttive o specifici schemi normativi. In questo contesto, il presente studio ha come obiettivo analizzare la disobbedienza civile nell’ambito della vaccinazione contro il COVID-19. La metodologia adottata è qualitativa, di natura teorica e argomentativa, basata su una revisione bibliografica critica con approccio ermeneutico, condotta attraverso una ricerca nelle banche dati SciELO e Google Scholar, con l’obiettivo di raccogliere dati rilevanti sul tema proposto.
Dall’analisi dei dati è emerso che, in generale, la disobbedienza civile è più apertamente comunicativa e politica rispetto all’obiezione di coscienza. La disobbedienza civile è, quasi per definizione, una violazione della legge, nella quale gli individui si impegnano con l’intento di forzare un cambiamento nelle pratiche governative o non governative. Sia la disobbedienza civile che l’obiezione di coscienza possono essere osservate negli atteggiamenti di coloro che si rifiutano di ricevere il vaccino contro il COVID-19, generando urgenti sfide normative e politiche relative alla natura dello stato di diritto, al rispetto dello stato di diritto, alle condizioni per una democrazia deliberativa, all’uguaglianza davanti alla legge, al controllo dell’ordine pubblico, al giudizio e alla punizione. Si conclude che è cruciale raggiungere un equilibrio tra l’autonomia individuale e la responsabilità collettiva nella promozione della salute pubblica.
