Challenges of sexing in preimplantational genetic diagnosis: limits of autonomy, diversity and identity from a bioethical and legal perspective

In this paper, it is proposed to discuss the use of assisted human reproduction, specifically regarding the use of preimplantation genetic diagnosis. Faced to the evolution and the possibility of not only identifying possible diseases in the offspring, but also the sex of the embryo, using the deductive method and the procedures of bibliographic and legislative review, it is reflected on the ethical limits that involve the use of this technique within the Brazilian scope. It is concluded that the regulations regarding the limits of use of the technique are scarce, that there may be legal support to admit the preimplantation genetic diagnosis to prevent serious diseases, however, its use to define the sex of the embryo hurts the freedom of gender identification, which can generate social control.
