Abstract

This article is a legal-comprehensive and exploratory study of Robert Alexy's weight formula, with the aim of critically addressing the evolution of this author's thought, especially about the important argumentative instrument invoked in numerous studies and decisions lawsuits, which is the weight formula. It is believed that the descriptive and critical study of this theory will help in the adequate understanding of the theme, considering the essence and the intention of its author. Therefore, it was chosen, methodologically, to describe it chronologically and in terms of content to understand how the Weight Formula evolved, transformed, and refined. In the end, an attempt was made to outline the appropriate and current way of understanding the weight formula according to Robert Alexy's thinking, with the aim of helping to better understand, apply and study this theory, which is often understood and used wrongly.
