Abstract

With the advancement of technology, there have been significant changes in the free flow of data in democracy, due to the emergence of the disturbing problem of the spread of fake news on the internet. The relevance of the study persists not only in the fact that the deliberate dissemination of disinformation produced by anonymous sources has undermined the credibility of journalism, but has also caused damage to the good development of democracy in the confrontation of facts and ideas in matters of interest. public. A task that requires pointing out how journalism has changed due to the production of meaning in media operations, highlighting the diagnosis of the Inter-American Commission on Human Rights (IACHR) regarding the issue of fake news in Brazil and, finally, elucidating how the IACHR aims to solve the circulation of false news in Brazilian lands. It is important to emphasize that the research is structured through the dialectic deductive approach of legal provisions, bibliography and reports of the IACHR. The research brings as a contribution the identification and analysis of six principles to standardize the free circulation of information, such as: universal access, non-discrimination, pluralism, privacy, the exceptionality of limits to the circulation of ideas and information and, finally, neutrality of network. It is concluded that the exercise of freedom of expression must be regulated with great accuracy, in order to avoid the risk of applying prior censorship.
