Abstract

This article analyzes the constitutional role of the State for providing health care and its liability due to its omission. However, before focusing on the responsibility of the State, as prescribed by the Federal Constitution, it was conducted an analysis on the health and medical assistance as fundamental rights of the Brazilian citizen.
